License/Education/Training

 Heather Fisher is a licensed professional fiduciary with California Professional Fiduciary License number 763.

 Ms. Fisher received a Bachelor of Science degree in Management from San Francisco State University in 2001 and is owner of Fisher Fiduciary Services, Inc..

 Ms. Fisher received training as a professional fiduciary interning with Dr. Fred Isaacs of Isaacs Fiduciary Services beginning in October of 2013. She continued to work with Dr. Isaacs until his retirement, at which time, she took over his practice. In addition to managing her own clients, Ms. Fisher works with other professionals providing case management, consultation, and accounting services.

 

Prior to becoming a professional fiduciary, Ms. Fisher obtained substantial experience as a subrogation specialist negotiating settlements for a major rental car company and was a manager and national trainer with Restaurants Unlimited and with the Darden Corporation.

 

Ms. Fisher earned her paralegal certificate with honors from the Center for Advanced Legal Studies in 2010, and currently holds the CGC certificate in Special Needs Trust Administration.  

 

Ms. Fisher is a former President of the Stanislaus County Estate Planning Council (SCEPC), is on the State Board of the Professional Fiduciaries Association of California (PFAC) and is a member of the National Guardianship Association (NGA).

 

Following are the fees for usual and customary duties/services provided by Fisher Fiduciary Services, Inc., and its staff:

 Agent Under Power of Attorney/Agent Healthcare Directive

$195 per hour

Guardianship/Conservatorship of the Person and/or Estate

(Guardian/Conservator fees are subject to court approval)

$195 per hour

Receiverships

$250 per hour.

Probate Administration Fees

Fees payable to the Professional Fiduciary as the Personal Representative for customary services are authorized under Probate Code §10800 and, pursuant to Probate Code §10800 are computed on a fee base comprised of gross assets, plus receipts and gains, less losses, as follows: 

4% of the first $100,000                                              1% of the next $9,000,000

3% of the next $100,000                                              0.5% of the next $15,000,000

2% of the next $800,000                                              Court discretion after $25,000,000

 

In addition to statutory fees, pursuant to Probate Code §10801, extraordinary fees can be requested for services such as, but not limited to, tax issues, real property sales and litigation.  Though fees for extraordinary services are subject to court approval, extraordinary services are charged at the minimum allowable county rate.

 

Trustee Fees

 

The fee range for standard, non-court supervised trust matters are as follows based on the total value of the assets of the estate:

Under $500,000 – 2%                                   $1,000,000 - $4,999,999 – 1%

$500,000 - $999,999 – 1.5%                      Over $5 million – .75%

 

All Court Supervised, Special Needs Trusts, Ongoing Trust Administrations, and Complex Trusts are billed at the minimum allowable county rate.

When billed on an hourly rate, all services provided by Fisher Fiduciary Services, Inc. and its staff are billed at one rate, practicing under a very simple pass through of operations approach unless otherwise specified. Time is billed in tenths of an hour with a starting minimum of .20 for all tasks.

Description of Services 

Usual and customary services billed may include, but are not limited to: case management; administrative; transportation; making medical and personal care decisions for clients; communicating with doctors and care givers to make sure the client gets necessary care; evaluating and determining the least restrictive appropriate residence to meet the client’s needs; bookkeeping; accounting; bill paying; reviewing tax returns; communicating with investment and financial advisors; real property management including buying, selling, leasing, and maintaining residences, investment, and vacation properties; corresponding and communicating with clients, family members, attorneys and others; attending court proceedings.
